28 year old Jayson Kilroy and 30 year old Edgar Juarez’s killer could be granted parole and may serve only 13 months after being charged of vehicular homicide. The two cyclists were hit by a truck driven by the motorist, Barbara Thomas, under the influence of barbiturates and morphine. Thomas was found guilty but the parole hearing is yet to come.

Thomas was alleged with other cases such as shoplifting at the Safeway in Colorado and hitting another car before she went her way to the intersection of 26th Street and Westend Avenue where she hit both cyclists along with 3 others. She was charged with four convictions of shoplifting dating back to 1983, drinking in a vehicle, careless driving and traffic infractions even before the incident. To top that, police had been in search for her for a hit-and-run two months before the death of E.J and Jayson.

DUI applies to cyclists 248x300   DUI Applies to CyclistsThe D.C. Court of Appeals sent out a ruling that a person who is riding a bicycle is subject to DUI. Associate Judge Vanessa Ruiz cited the validity of this decision. “The traffic act defines ‘vehicle’ as ‘any appliance moved over a highway on wheels or traction tread, including street cars, draft animals and beasts of burden. Furthermore, a comprehensive interpretation of the term ‘vehicle’ is consistent with the intent of the traffic act to regulate traffic for the protection of public safety.”

The root cause of the decision came from a case in January 12, 2007. It was about Baker Everton who was found standing with his bicycle on Georgia Avenue, Northwest. Near Otis Place, the police found him yelling and screaming. He was obviously drunk due to the strong smell of alcohol on him.

Maryland State Senate passed five safety bills for cyclists and is probably about to move up notches in League of American Bicyclists Bike-Friendly rankings. This month’s State’s General Assembly became the venue for five smart transportation bills to break ground.

One Less Car says this is a success. As what its mission statement is, the movement encourages many through educational campaigns, lobbying and open debates and dialogues between the public via communities, governments, and local and state representatives.

Local alternative transportation groups of Maryland also joined in the cheering and further fight to strengthen the rights of cyclists and pedestrians alike.
